Terms and Conditions For The State Of Florida

  1. BUYER’S RIGHT TO CANCEL: If this is a “home solicitation sale” as defined by Fla. Stat. §501.021, then the following applies: This is a home solicitation sale, and if you do not want the goods or services, you may cancel this agreement by providing written notice to the seller in person, by telegram, or by mail. This notice must indicate that you do not want the goods or services and must be delivered or postmarked before midnight of the third business day after you sign this agreement. If you cancel this agreement, in accordance to these terms, the seller may not keep “all or part of any down payment paid to seller.”
  2. Installation Period: Although Bath Crest of South FL, LLC (hereafter “Bath Crest”) will make every effort to do so, we cannot guarantee that your installation will be completed in one day. If the installation takes more than one day, customer agrees that Bath Crest shall not be responsible for any reimbursement, discount, or any other type of compensation to you for claims of inconvenience or any other damages. All merchandise must be installed within 180 days from Sale Date.
  3. Plumbing Facilities: Bath Crest shall not be held responsible for inspecting, servicing or modifying your existing plumbing facilities. If, during the installation of Bath Crest products, we determine that the existing plumbing is deficient, needs repair or adjustment, Bath Crest will notify you as soon as reasonably practical. If plumbing repairs or modifications are needed, you may incur additional expenses to have the plumbing corrected before the Bath Crest installation may be completed. In addition, because the existing plumbing may be old, corroded or in need of repair or replacement, customer agrees that Bath Crest shall not be held responsible for any damages to the plumbing below or behind the tub, shower or walls, including shut-off valves or for any damages caused by faulty plumbing.
  4. Removal and Reinstallation of Shower Doors or other Customer Supplied Items: Although Bath Crest will make every effort to successfully remove and reinstall existing shower doors, fixtures, grab bars etc… this process cannot be guaranteed. In the event the items no longer fit, are damaged or result in damages to item, walls or property during the removal or reinstallation process, customer agrees that Bath Crest shall not be held responsible for any such damages, reimbursement, discount, or any other type of compensation to you.
  5. Wall Repair: If during the installation phase, Bath Crest is required to perform unforeseen repairs to your existing walls, we will notify you immediately of any additional charges that may apply.
  6. Molds: Molds occur naturally in almost all indoor environments. Mold of any spores enter homes through open doorways, windows and a variety of other ways. Bath Crest and its representatives make no warranty or representation of any kind, express or implied, regarding the presence or absence of mold, or regarding the effectiveness of any biocide designed for reducing the presence, effect, or growth of mold. Customer agrees to release Bath Crest from any related claims or liabilities, as Bath Crest is not qualified to provide advice on mold detection or clean-up.
  7. Deposit Refund: The deposit is a firm and binding commitment for both parties engaging in this contract. The deposit is not refundable after the 3 day cancellation period (“Buyer’s Right To Cancel”) if the customer decides to cancel this contract. Because Bath Crest products will be custom made for you, we cannot refund your deposit after the 3 day cancellation period has expired.
  8. Changes: It is expressly agreed that there are no promises, representations, agreements or understandings outside of this contract and any changes or modifications must be mutually agreed upon in writing and signed by both parties. For any changes requested by the customer resulting in a reduction of the scope of work, accessories, product options or products as stated and already ordered in this contract or in any subsequent change order(s), the customer will be charged a $150.00 administration fee for each change.
  9. Payment Options: Bath Crest offers third party financing for qualified buyers. If you choose to finance your purchase and your application is approved, the third party finance contract will control any conflicting terms that are in this purchase contract, including but not limited to the monthly payment amount and payment terms. The option of financing is only available, and must be selected, at the time you place your order.
  10. Final Payment: Final payment is due immediately upon completion of the installation. The materials installed will remain the property of Bath Crest until final payment has been received. Customers will be charged a fee of $50 for any returned checks. Interest charges of 1.5% per month or the maximum legal rate of interest, whichever is greater, will be added to the balance due from the date of completion. In the event of a dispute arising out of this agreement, the prevailing Party or Parties shall be entitled to recover their reasonable costs and attorneys’ fees including, but not limited to, such costs and fees incurred prior to the institution of litigation, and/or in litigation.
  11. Warranty: All acrylic material carries a limited life time warranty: See all applicable conditions and restrictions established by Bath Crest. For all other products or materials provided, the applicable warranty is from that of the manufacturer; see all applicable conditions and restrictions established by the respective manufacturers. All silicone applications carry a one year warranty. All warranties provided are non-transferable and applies only to the original purchaser.
